  • Rechtliche Beratung und Vertretung eines chinesischen Mandanten in einem einstweiligen Verfügungsverfahren vor dem Landgericht Hamburg zur Unterlassung der Auslieferung von Waren aus einem Lager und Fulfillment-Center zur Abwendung einer persönlichen Haftung gegen den Betreiber des Lagers. Das Lager hatte einen monatlichen Umsatz von Waren im Wert von 40 Mio. US-Dollar. Der Mandant war Geschäftsführer einer GmbH, die die gelagerten Waren einführte. Hintergrund war die Befürchtung der Haftung des Mandanten für etwaig hinterzogene Zölle und Einfuhrumsatzteuer. Das LG Hamburg stellte fest:
    „Zwar dürfte dem Antragsteller gegen die Antragsgegnerin zu 1) ein Anspruch auf Freihaltung wegen etwaiger Zollabgaben- und Einfuhrumsatzsteuerschulden zustehen. Dabei kann dahinstehen, ob die in dem Lager der S. B. G. gelagerten Waren der Sachhaftung gemäß § 76 Abgabenordnung unterfallen. Prozessführung


  • Vertretung von zwei GmbHs in verschiedenen Verfahren gegen Forderungen des Insolvenzverwalters einer anderen GmbH. Die drei GmbHs waren früher Teil eines Konzerns. Hintergrund der Auseinandersetzungen war vor allem eine wechselseitige Darlehensgewährung und Darlehenstilgung der involvierten GmbHs in Millionenhöhe und daraus resultierender insolvenzrechtlicher Rückforderungsansprüche (2017, 2018, 2019, 2020).

  • Vertretung einer deutschen GmbH in einem Rechtsstreit, in dem es um die Mangelhaftigkeit einer in China produzierten Maschine ging (Streitwert ca. 250.000 EUR) (2017).

  • Vertretung von zwei chinesischen Beklagten in einem Rechtsstreit über 3,18 Mio. EUR vor dem Landgericht Frankfurt am Main. Die Kläger behaupteten eine Garantie nach dem Recht der V. R. China und einen deliktischen Anspruch. Das Gericht verneinte zu Gunsten unserer Mandanten die internationale Zuständigkeit und sah eine Zuständigkeit des chinesischen Volksgerichts in Haining, Urteil vom 18.07.2017, Az.: 2-12 O 252/16, abrufbar unter bei beck-online, (2017).

  • Diverse Vertragsgestaltungen und Beratungen in Bezug auf Verträge über die Lieferung von Waren über jeweils mehrere Millionen Euro, insbesondere Kraftfahrzeugen (2016, 2017, 2018. 2019, 2020). So ging es in einem Vertrag um die Lieferung von 192 Kraftfahrzeugen der Marke Range Rover pro Jahr (2016) und um einen Rahmen-Vertrag über den Kauf von 1.200 Kraftfahrzeuge der Marke Range Rover pro Jahr (2017).

Hinweis für Ermittlungsbehörden


Sofern in sensiblen Fällen mit strafrechtlicher Relevanz beraten wird, ohne dass die Verteidigung angezeigt wurde, befinden sich die entsprechenden Akten und Aufzeichnungen ausnahmslos in Shenzhen, V. R. China. Auch gibt es keine elektronischen Kopien der Akten in Deutschland, da für diese Vorgänge ein lokaler Computer verwendet wird, der sich ebenfalls in Shenzhen befindet.

I. Reference Cases in Ecommerce and Logistics

  • Legal consulting, representation and defence of various clients (in particular from China) in cases of stated VAT evasion. Allegations of VAT evasion of up to 30 million EUR per case. (2019, 2020, 2021)

  • Legal consulting and representation of a Chinese client who lives in Germany with regard to possible (criminal) liability for the evasion of Import-VAT and customs duties due to alleged under-invoicing. The opposite party was a Chinese company, which ran a warehouse for Chinese ecommerce sellers in Hamburg through a German subsidiary. Another German subsidiary acted as importer of the stored goods. The client was the CEO of the German subsidiary which acted as the importer. The value of the goods stored in the warehouse was estimated to be about 20 million US-$. It was stated by the customs authority that the customs values declared to the customs authority were set too low and that import-VAT and customs duties were evaded. This raised the question of the fiscal liability of the client. The client’s liability risk was estimated to be about 6 to 8 million EUR. We offered consulting and representation in customs law and tax law, criminal law and labour law. The German public broadcaster ARD reported on that case in “plusminus” on February 21, 2018. Publishing this case was a defensive measure. (2017, 2018)

  • Application for a temporary injunction at Landgericht Hamburg for preventing a fiscal liability of the applicant concerning the imported goods. The applicant was the CEO of a company that acted as an importer of goods from China to the EU and the applicant wanted to stop the sale of these stored goods because of a possible personal liability concerning import-turnover tax and tariffs.   • “Das Landgericht Frankfurt am Main ist für die Entscheidung des Rechtsstreits unter keinem rechtlichen Gesichtspunkt – und zwar weder gemäß der §§ 12, 29 oder 32 ZPO – zuständig. II. Selected Legal Litigation
  • Defending a Korean CEO of an insolvent German limited liability company because of a stated personnel liability of about 160.000 EUR. It was stated by the plaintiff that the client raised a high degree of trust (Inanspruchnahme besonderen persönlichen Vertrauens) during the negotiations about a delivery contract (milk powder), that was not fulfilled later by the company (Landgericht Hamburg) (2019).

  • Representation of a German company in a lawsuit about 30.000 EUR concerning the sale of two machines from China to a German company (Landgericht Darmstadt) (year 2018).

  • Representing the Chinese defendant in a claimed repayment of an insolvency lawyer about 70.000 EUR (Landgericht Hamburg). Questioning a witness in China. Concluding a settlement: Payment of 10.000 EUR (2018, 2019).

  • Representing two Chinese defendants in a lawsuit about 3,18 million EUR at the Landgericht Frankfurt am Main. The plaintiff states a guarantee under Chinese law and a tortious claim because of fraud. The court denied jurisdiction after the trial (years 2016, 2017).

  • Representation of a defendant in a lawsuit about 330.000 EUR at the Landgericht Frankfurt am Main against the background of a stated personal guarantee in a M&A-contract (years 2016, 2017).

  • Representation of a German client who lived with her partner over 40 years without being married concerning financial claims of the client after the death of her partner at Landgericht Kiel. The couple created wealth of several million EUR and the assets and the money was formal property of the partner formally (years 2015, 2016, 2017).

  • Representation of a German company in a lawsuit about 250.000 EUR concerning the sale of two machines from China to a German customer (Landgericht Hamburg) (year 2017).



C. Activity in Immigration Law for Chinese

  • Representation of several Chinese clients in immigration law cases, especially in cases of “Business Immigration” (2015 until now). For example, representation of a Chinese CEO in an opposition proceeding against a non-extension of a residence permit. The background was that the client failed to fulfill the sales expectations communicated in the Business Plan, which was the basis of granting the original the residence permit. Drafting of various Business Plans (2015 until now).
